Terms and Conditions

1. Information on how to enter and prizes form part of the terms and conditions of entry. Entry into the competition is deemed acceptance of these conditions of entry. All entries are via the website www.take40.com. Incomplete or incomprehensible entries will be deemed ineligible. This is a Game of Skill and chance plays no part in determining the winners.

2. To enter the competition, users will be required to log onto the website and click through to the "Take 40 MIKA" artist profile and tell us in 25 words or less: "What is your favourite childhood memory and why?" All answers are required in English. The user will also be asked to register their details for an entry into the competition. Entrants will be required to leave their details including name, date of birth, address, phone number and e-mail address.

3. Entry is open to all Australian residents who are aged 10 years and over Employees of mcm entertainment and their immediate families, associated agencies of mcm entertainment and companies associated with the promotion are not eligible to enter the promotion.

4. The competition commences on 30th October 2009 at 12:00pm (AEST) and all entries must be received before Monday 16th November 2009 at 12:00pm (AEST).

5. All responses will be read and judged by a judging panel at mcm entertainment, Level 1, Building 210, The Entertainment Quarter, Moore Park, NSW 2021 at 2.00pm (AEST) on Monday 16th November, 2009. The winners will be notified by mail within 5 working days of the relevant judging date. Winners will be determined on their creativity.

6. The prize pool consists of 1 x major prize. 1 x major winner will have the opportunity to meet Mika and interview him in Sydney between 20th - 30th November 2009. Exact time, date and venue yet to be confirmed.

During the promotional period the most outstanding or creative entries from www.take40.com will win the prizes.

Please be advised the travel to and from the location of the interview will not be provided and is the responsibility of the winner.

The total prize pool is valued at $0 - this is a 'money can't buy' experience! The Promoter will not be held responsible if a component of the prize (outside the control of the Promoter) is unavailable. In the event that such component is unavailable, the Promoter will provide the prize winner with a substitute prize to the same or equal value.

7. The Promoter will not be held responsible if a component of the major prize ie: meet and greet (outside the control of the Promoter) is cancelled. In the event that such component is cancelled, no replacement activity will be offered. The prize must be taken on the confirmed date and must be taken as offered.

8. In the event that for any reason whatsoever any prize winner does not or is not able to take any prize at the time stipulated by the Promoter for any reason, the prize will be forfeited by the winner and cash will not be awarded in lieu of the prize.

9. Judges decision is final and no correspondence will be entered into. Prizes are not exchangeable or transferable and prizes cannot be redeemed for cash.

10. Prize values are the recommended retail value as provided by the supplier and are correct at time of printing. The promoter accepts no responsibility for any variation in prize value.

11. If a winner is under 18 years of age, their prize may, at the absolute discretion of the Promoter, be awarded to that winners' parent or guardian.

12. The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to direct or consequential loss) or for any personal injury suffered or sustained in connection with any other prize/s except for any liability which cannot be excluded by law.

13. mcm entertainment and their associated agencies, and companies associated with this promotion will take no responsibility for prizes damaged or lost in transit. Once prizes have left Promoter's premises, the Promoter will not be responsible for any delay in delivery, or failure of safe delivery of prizes.

14. It is a condition of accepting the prize that the winner and their guests may be required to sign a legal release in a form determined by the promoter in its absolute discretion.

15. The promoter reserves the right to request winners to provide proof of identity, proof of residency at the nominated prize delivery address, and/or proof of entry validity. Proof of identification, residency and entry considered suitable for verification is at the discretion of the promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit their prize in whole and no substitute will be offered.

16. All winning entries become the property of the promoter. All winning entries will be entered into a database and the Promoter may potentially use the entrants' names, addresses, telephone numbers and e-mail addresses for future promotional, marketing and publicity purposes in any media worldwide without notice and without any fee being paid unless otherwise advised by the entrant.

17. If for any reason this promotion is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of the Promoter, which corrupt or affect the administration security, fairness or integrity or proper conduct of this promotion, the promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition

18. In the case of the intervention of any outside agent or event which naturally changes the result or prevents or hinders it's determination, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strikes; the Promoter may in its absolute discretion cancel the event and recommence it from the start on the same conditions.
